I know that in the state of Illinois, you must hire a lawyer to get a divorce when children are in the picture. You can use your own lawyer or you and your husband can use the same lawyer. Usually, if the two of you are not in agreement, then you want your own lawyer.

Unless you're a crack-ho, you will probably have joint custody. One of you will have primary guardianship, meaning the kids live with you for the most part and the father has a set visitation schedule.

As far as taking the kids out of state, it will not be easy for him to do. My husband has dragged out the divorce trying to make me live in the same town as he does, but the town I want to move to is a reasonable distance away, so I'm confident I'm going to win on that. However, if I were moving out of state, he'd be in a good position to get primary custodianship.

Good luck.

If you cannot afford a lawyer, you can't afford the kids.

Unfortunately you will need a lawyer. Call around. There are lawyers that might work with you.
