Deffinately! I had a similar problem. I didn't want to sue them, so I talked to the hospital admin. and they took care of my bill.
But, if it caused your son damage, that is more than enough proof to get a settlement. Get a lawyer, but don't sigh anything that states he gets over 25%. You shouldn't have to pay anything up front either. Your case is enough to get something. Call the hospital and get all of the dictations from the doctors in the ER for both visits. Also, get it from the ambulatory service. You have a total right to all of those papers. Don't let them tell you otherwise. Give all of those to a lawyer. Hope this helps.

Getting a lawyer is might be difficult, you should try to take advice from your friend, or some people, who know much about lawyer, and who can really help you.

how sad it is for your son! you have to call a lawyer . first, it is because you felt that your rights and your son's has been violated. second, you felt that the hospital held liability on the accident that worsen the situation for your son.
