Need more facts to answer this question. Sounds like your attorney entered in evidence for damages only. It seems like doctor's records to show injury would have been helpful, but again, it is extremely fact sensitive. Cannot answer this question without knowing a) what the arbitration was over, and b) what evidence was actually available (but not submitted).
